SHOOTING YOUR LAWYER

I HAD to speak to my little brother, the reknowned criminal defense attorney, after that video shooting. Actually, he called me. I thought he'd be indignant about that sort of client behavior. He was laughing his ass off.

Don't you think that was reprehensible? I said.

Fuck no, he said. That bastard probably deserved it. I've seen clients screwed over by the likes of THAT guy for years. He's lucky he wasn't killed. Probably fucked his client over real bad.

I think that's kind of cool. And to the Georgia Bar Association Ethics Committee I say, for the record, my brother never actually said that.

Behavior has consequences.
Of course, soemtimes you're just dealing with a fucked up individual.
This was a probate matter. You haven't seen thievery until you watch lawyers pick over estates. The guy's dead, so it's not really stealing, right?

I don't wish getting shot on anybody but damn that was funny. The Lawyer was dancing around that tree. Gives a new meaning to Ring Around the Posey. He was lucky the guy was a bad shot cause he kept on firing at him. Wonder if the lawyer will still bill him??

From what I read, the shooter was almost at point blank range.

Unless I read the story wrong, the lawyer wasn't representing that guy. He was representing someone trying to get more money from the shooters trust fund.

I saw the video. Funny as hell, but the report said the lawyer was in serious condition. Couldn't tell from the way he was dodgin' and dancin' around the tree.

Grow a brain. It's not funny when anyone gets shot. And it certainly isn't funny when a guy is "tap dancing" for his life.

And for the record, the attorney was representing the shooter. He was about to be subbed in as the trustee for the shooter's estate, because the prior trustee had resigned due to death threats from the shooter. And it wasn't a probate case - the trust was formed because the shooter had already previously won a large inury settlement (no doubt at the hand of another lawyer you all would rather shoot). The "tap dancer" you all laugh at hadn't even met his new client yet - he was supposed to meet him at the hearing. Way to welcome the help.

You should get your facts straight before you make cliche remarks about "kill all the lawyers". Perhaps you fuckers forget they have wives, kids, husbands, and families that love them. Go ahead and blast me - but let me say this in advance: No, good sir, FUCK YOU.

But tell me - Are there any lawyers where you live who in fact deserve to be somebody's target pratice?
I stand by my earlier comment about probate and estate matters. The problem is, probate work is not typically adversarial, so there is no opposing party and opposing counsel to keep track of things. I have seen shameless skullduggery, Clintonian lying (through parsing of language), and out-and-out thievery in my limited probate court work. Somehow, the lawyers never get screwed in trust and estate matters.

I'm a real estate transactional lawyer, who moonlights as a SQL guru, so my experience with probate matters is minimal at best. But I do have acquaintances who either practice probate, or have been mediators in probate cases. They tell me that only family law is more adversarial - there is nothing that gets people more in a tizzy than some dead person's money they think they own or have some right to. In such contested matters, the lawyers are paid as you would expect - generally by the hour on a retainer, or perhaps rarely on a contingency.

I suspect you're asking about more bland probate matters, which are really little more than an administrative task. The fees in such cases are generally set by statute, at least insofar as the attorney is handling the adminstration of the estate. At least that's my understanding of how they work - I could be wrong. There isn't much room for skullduggery and what not, even if the attorney wanted to. But remember, I have handled exactly -0- probate matters, so what do I know.

If you're saying that there are plenty of lawyers who are abusive, self-centered, and much more interested in generating fees or billable hours than in solving their clients' problems, I'd say you're right on, Mr. Straw. Which is why I detest litigation and try to avoid it - I'll do the transactional work and let someone else litigate over it. Law used to be a noble profession, where we earned our fees by helping people solve their problems civilly and responsibly. That professionalism has disappeared in many sections of the bar, to be replaced with ad hominems and like tactics - any advantage, no matter how small, is the goal. Many lawyers call this "zealous advocacy". I call it a pile of aromatic manure de horsey.

That's the long answer. The short answer is both yes and no.

The comment above was a direct quote from Shakespeare. Being from the medical field (anesthesia) I do despise attorneys. I do not think they should be killed merely drawn but not quartered or feathered but not tarred. Then driven out of town. C'mon, some of these attorneys are quite out of hand. I say cap their fees like they did the doctors fees.

This was an unusual case. The alleged shooter's prior attorney was evidently not contacted by the new attorney.

I could go on and on but it's late.

Gingerly by the hour?? A recent family divorce that was uncontested was being billed at 285.00 per hour. You should see the bills. They are amazing.

I have to agree with El Jeffe--replace the lawyer with your mother and I doubt it would be as funny.

As for the Shakespeare quote: It's always taken out of context. In the play (Henry VI, not sure of which part) two characters are discussing how best to overthrow a government. The first step, it's agreed, is to kill the lawyers.

That Heffe guy is the bomb. Granted, I actually know who he is, so I know he's the bomb, but that's beside the point. Let's just say he's a verbose Veloci of sorts. Me? I just like it when someone doesn't go with the flow.

And for the "fuck/kill/maim/quarter the lawyers crowd, I ask you this: what profession is there in this world that is NOT full of asshole moneygrabbers, back stabbers, and skulldrudgery?

I'm an artist and an academic these days, and before getting here I've worked enough jobs in enough industries to know that shit can pile up just about everywhere.

Why, some asshole just cut me off on the way home tonight! Probably trying to get home to blog for the night.....

First probate matter I ever handled an old woman came to me. Her friend had died and left everything to my client and a third friend. $12,000.00. They get six grand each, right? WRONG !!!
My client came to me because the lawyer who had been named as executor by the dead little old lady billed $11,836.00 The little old ladies got $87.00 each.
